Terms of Use
These terms are an agreement between you and the developer of Tinnitus Haven (“we”, “us”). By downloading or using the app you accept them. If you do not accept them, please do not use the app.
Read this first: Tinnitus Haven is not medical care
Tinnitus Haven is a wellness app. It is not a medical device. It does not diagnose, treat, cure or prevent any illness, and it does not replace an examination by a doctor or audiologist. Its hearing and tinnitus self-test is a screening aid that gives you a rough indication — not a clinical audiogram.
See a doctor promptly if your hearing drops suddenly, if the ringing is only in one ear, if it pulses in time with your heartbeat, or if it comes with dizziness, ear pain, discharge or facial weakness. These can be signs of a condition that needs urgent medical attention. In an emergency, call your local emergency number.
1. Your licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to use Tinnitus Haven on any Apple-branded device that you own or control, as permitted by the App Store Terms of Service (including the Usage Rules). If Family Sharing is enabled for the app, members of your family group may use it under the same terms. The app is licensed to you, not sold.
2. What you may and may not do
Use the app for your own personal wellbeing. Please do not:
- copy, sell, rent, sublicense or redistribute the app or its audio content;
- reverse engineer, decompile or disassemble it, except where the law expressly allows you to;
- remove or obscure copyright or other proprietary notices;
- use it to provide a service to others, or present its output as a clinical assessment;
- circumvent the subscription mechanism.
3. Medical disclaimer
Everything in the app — the sound therapy, the self-test, the mindfulness exercises, the CBT-style programme and any text or figures shown — is provided for general wellbeing and education. It is not medical advice and creates no doctor–patient relationship.
- The app does not diagnose tinnitus, hearing loss or any other condition. Results are an indication only.
- The self-test runs on consumer earphones that are not calibrated, in a room that is not sound-treated. Results typically deviate by roughly ±10 dB from a clinical audiogram, and can deviate more.
- Never use the app instead of seeing a clinician, and never stop or change a treatment because of something the app showed you.
- Tinnitus can have medical causes. Only a clinician can identify them.
We make no claim that the app cures, reduces or relieves tinnitus. It is a set of tools some people find helpful for living with it.
4. Hearing safety
The app plays sound through your headphones and can produce loud tones during the self-test.
- Start at a low volume and raise it only as far as you need. Never turn the volume up to a level that is uncomfortable, painful or that makes the ringing worse.
- Loud sound over long periods damages hearing permanently. Take breaks.
- Stop immediately, and see a clinician, if a sound causes pain, dizziness or a lasting increase in your symptoms.
- Do not use the app while driving, cycling, operating machinery or in any situation where you need to hear your surroundings. Sound therapy and mindfulness sessions may make you drowsy.
- If you use a hearing aid or a cochlear implant, ask your audiologist before using tone-based features.
5. Subscriptions and payment
Some features require Tinnitus Haven Premium, an auto-renewing subscription:
- Monthly — USD 5.99 per month
- Annual — USD 49.99 per year
There is no free trial. Prices are the standard US prices; in other countries Apple charges the equivalent price for your storefront, and the price shown in the app before you buy is the one that applies, including any taxes Apple collects.
Everything about the transaction is handled by Apple:
- Payment is charged to your Apple account at confirmation of purchase.
- The subscription renews automatically at the end of each period unless you cancel it at least 24 hours before the period ends. Apple charges the renewal within the 24 hours before the period ends.
- You manage and cancel your subscription in iOS Settings → your name → Subscriptions — not in the app, and not by deleting the app. Deleting the app does not cancel anything.
- Cancelling stops future renewals. The subscription stays active until the end of the period you already paid for; part-periods are not refunded by us.
- Refunds are handled by Apple, under Apple's Media Services Terms, at reportaproblem.apple.com. We cannot issue refunds for App Store purchases. This does not affect any statutory right you have as a consumer.
- If prices change, Apple asks for your consent before charging a higher renewal price, in the way its rules require.

6. Consumer rights
If you are a consumer in the EU/EEA, the UK or Turkey, you have statutory rights that these terms do not limit. Because the app is bought through the App Store, any right of withdrawal, cancellation or refund for the purchase is exercised through Apple as the seller of record, using the refund link above. Nothing here affects mandatory consumer-protection law in your country of residence.
7. Your content
Your journal entries, test results and everything else you create in the app stay yours, and stay on your device. We never receive them, so we claim no rights over them and cannot recover them for you if you delete them or lose the device. If they matter to you, use the export function in Settings → Privacy & Data and keep a backup.
8. Our intellectual property
The app, its source code, design, name, logo, audio programmes and written content are owned by the developer of Tinnitus Haven or its licensors and are protected by copyright and other laws. Your licence gives you no rights to them beyond using the app as described here.
9. Availability and changes
We may update the app, change or remove features, or stop distributing it. We will not deliberately break a subscription you have paid for; if we discontinue the app while your subscription is running, Apple's refund process remains available to you. Continued availability may also depend on Apple, on iOS versions and on your device.
10. Warranty
Beyond the guarantees the law gives you as a consumer, and to the extent the law allows us to say so, the app is provided “as is” and “as available”. We do not warrant that it will be uninterrupted or error-free, that its measurements are accurate, or that it will produce any particular result for your tinnitus.
As Apple's terms require: in the event of any failure of the app to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price of the app to you. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the app. Any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are our responsibility, not Apple's.
11. Limitation of liability
To the extent permitted by law, we are not liable for indirect or consequential loss, loss of data, or loss arising from your reliance on the app instead of professional medical care. Our total liability for any claim relating to the app is limited to the amount you paid for it in the twelve months before the claim arose.
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded — including your mandatory rights as a consumer.
12. Apple
Apple requires the following, and it is accurate:
- This agreement is between you and us only, not with Apple. Apple is not responsible for the app or its content.
- Apple has no obligation to provide maintenance or support for the app. Support is ours — write to info@tinnitushaven.com.
- We, not Apple, are responsible for any product liability claim, any claim that the app fails to conform to a legal or regulatory requirement, and any claim under consumer-protection or similar law.
- We, not Apple, are responsible for investigating, defending, settling and discharging any third-party claim that the app infringes that party's intellectual property rights.
- You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Third-party beneficiary: Apple and Apple's subsidiaries are third-party beneficiaries of these terms, and upon your acceptance of them, Apple will have the right (and will be deemed to have accepted the right) to enforce them against you as a third-party beneficiary.
13. Ending this agreement
You may end it at any time by deleting the app (remember to cancel any subscription separately). We may end it if you breach these terms materially. Sections 7, 8, 10, 11, 12 and 14 survive.
14. Governing law and venue
These terms are governed by the laws of Türkiye, and disputes will be heard by the competent courts of Türkiye. If you are a consumer, this does not deprive you of the protection of the mandatory law of the country where you live, and you may also bring proceedings in the courts of that country. Consumers in the EU can also use the European Commission's online dispute resolution platform; consumers in Turkey can apply to the district consumer arbitration committee (Tüketici Hakem Heyeti) or the consumer court.
15. Changes to these terms
We may update these terms — for example when features or prices change. The new version appears on this page with a new version number and date. If a change is material, the app will tell you about it before it takes effect, and continuing to use the app after that means you accept it. If you do not accept it, stop using the app and cancel any subscription.
